This Moving Services Agreement (“Agreement”) is entered into between Men In Trucks Moving Inc. (“Men In Trucks”, “MIT”, “Carrier”, “we”, “us”) and the customer signing below (“Customer”, “you”). By signing electronically, you confirm you have read, understood, and agree to be bound by the terms below.

1) Services Covered

Men In Trucks will provide moving and/or delivery services as described in your confirmed booking (the “Services”), which may include loading, transportation, unloading, placement of items, and standard furniture protection (blankets and wrap as needed). Any services not expressly included in your confirmed booking are not included unless agreed in writing.

Services that are not included unless specifically agreed in writing include: appliance disconnection/reconnection (water/gas/electrical), plumbing or electrical work, wall mounting, TV mounting, hoisting/rigging, crating, piano/safe moves, specialty items requiring special equipment, junk removal, or long-term storage.

2) Booking, Deposit, and Confirmation

A deposit is required to reserve your date, crew, and truck. Your booking is confirmed only when the deposit is received and you receive written confirmation from Men In Trucks (by email or text). Deposits are applied toward your final invoice unless stated otherwise.

3) Pricing and How Charges Are Calculated

All estimates are based on the information you provide, including addresses, item descriptions, stairs, elevators, long carries (walking distance from truck to door), building rules, access limitations, and any special handling needs. Unless a fixed price is explicitly agreed to in writing, the final invoice is based on the actual time and services used.

If conditions differ from what was disclosed or expected (including additional stairs, longer carries, tighter access, additional items, extra stops, waiting time, shuttle requirements, or specialty handling), the total time and cost may increase. Men In Trucks may request confirmation before proceeding with major changes, and your approval may be provided by text or email.

4) Payment Terms

The remaining balance is due immediately upon completion of the Services (end of unloading or delivery release). Payment must be available at completion. If payment is not ready, Men In Trucks may pause or withhold completion of service until payment is received. The customer is responsible for any bank charges, returned payments, or payment processing issues.

5) Customer Responsibilities (Access, Readiness, and Accuracy)

You (or an authorized adult representative) must provide accurate information about the move and ensure safe and legal access for the crew and truck. This includes ensuring pathways are clear, pets are secured, elevators are booked when required, loading zones or permits are obtained when necessary, and building rules are followed.

You are responsible for disclosing, in advance, any access issues or special conditions including stairs, narrow hallways, tight turns, long carry distances, limited parking, low ceilings, fragile items, heavy items, oversized items, or items requiring disassembly beyond basic furniture. Delays or additional labour resulting from undisclosed conditions may increase time and cost.

6) Delays, Waiting Time, and Factors Outside Our Control

Move time may be affected by factors outside Men In Trucks’ control, including traffic, weather, road closures, elevator availability, building restrictions, concierge delays, loading dock scheduling, and access limitations. When the crew and truck are on site and unable to work due to customer or building-related delays (including lack of access, no elevator booking, no keys, no parking, or items not ready), waiting time is billable and will be included in the final time.

7) Packing, Boxes, and Customer-Packed Items

If Men In Trucks provides packing services, we pack in a commercially reasonable manner. If the Customer packs boxes, totes, or containers, Men In Trucks is not responsible for internal damage caused by improper packing, overloading, under-packing, or shifting contents, unless the damage is clearly caused by an external impact while in our care.

8) Prohibited Items and High-Value Items

Men In Trucks does not transport hazardous, illegal, or restricted goods, including flammables, chemicals, solvents, propane, fuels, explosives, or any item that creates a safety risk. We also do not accept responsibility for cash, jewelry, passports, IDs, keys, important documents, medications, collectibles, fragile heirlooms, or other irreplaceable personal items. These items must be kept with the Customer and must not be placed in boxes or furniture to be moved.

If any prohibited or high-value items are discovered during the move, Men In Trucks may refuse transport or stop work until the items are removed, and any delay will be billable.

9) Condition of Items and Pre-Existing Damage

Men In Trucks is not responsible for pre-existing damage, normal wear and tear, hidden defects, or structural weakness in furniture (including particle board, veneer, flat-pack/assembled furniture, and items with weakened joints). The Customer understands that older furniture or flat-pack items may loosen or shift during transport even with careful handling. Men In Trucks is not responsible for internal mechanical or electrical malfunctions (TVs, computers, appliances) unless clearly caused by visible external impact that occurred while the item was in our care.

10) Damage Reporting and Claims

Any concerns about damage or missing items must be reported before the crew leaves the delivery location. The Customer should document concerns with photos and/or video at the time they are discovered. Reports made after the crew departs may be difficult to verify due to handling by others, building access, or subsequent movement of items.

If a claim is submitted, the Customer agrees to provide reasonable information (photos, description, and location) and a reasonable opportunity for Men In Trucks to inspect the item and propose repair or resolution where appropriate.

11) Liability Limitation

To the maximum extent permitted by applicable law, Men In Trucks’ liability for loss or damage is limited to direct physical loss caused by our handling while the item is in our care, and excludes indirect or consequential losses such as missed work, hotel costs, rebooking costs, loss of business, or other economic loss.

Men In Trucks is not liable for loss or damage resulting from: customer-packed contents, poor packing by the customer, pre-existing damage, hidden defects, normal wear and tear, items prohibited under this Agreement, unsafe conditions, or circumstances outside our control.

12) Cancellations and Rescheduling

Because we reserve crew and truck capacity for your move, cancellations or reschedules on short notice may result in the deposit being non-refundable. Men In Trucks will make reasonable efforts to reschedule where possible, but rescheduling is subject to availability and may require a new date confirmation.

13) Safety and Right to Refuse Service

Men In Trucks may refuse or stop work if conditions are unsafe or inappropriate, including unsafe stairs, ice hazards, aggressive pets, hazardous materials, illegal items, unsanitary conditions, or abusive or threatening behavior. If the move is stopped due to safety issues outside Men In Trucks’ control, the customer remains responsible for minimum charges and any time incurred up to the stoppage.

14) Governing Law

This Agreement is governed by applicable local laws and regulations in the jurisdiction where the Services are performed.

15) Entire Agreement and Changes

This Agreement, together with your written booking confirmation (email/text), represents the entire agreement between the parties. No verbal statements or promises are binding unless confirmed in writing by Men In Trucks. Any additions or changes to services may result in additional charges based on time and services required.

16) Electronic Signature and Electronic Delivery

The Customer consents to the use of electronic signatures and agrees that an electronic signature is legally binding. The Customer also agrees that this Agreement, confirmations, invoices, and related documents may be provided electronically (email or e-signature platform). Date/time stamps, verification logs, and audit trails may be used as evidence of acceptance.
